A Fort Dodge woman is facing a vehicular homicide charge after investigators say she crashed her vehicle head-on into another, killing the driver, last summer.
Aisha I. Ismail, 24, is charged with one count of homicide by vehicle, a Class B felony.
The charge comes as a result of the investigation into the July 9, 2018, death of David Fliehe, 20, of Humboldt.
The criminal complaint, filed with the Webster County attorney’s office, details that investigation, which was conducted by Trooper Neil Morenz, of the Iowa State Patrol.
The accident happened around 11:44 p.m. on July 9 west of Badger on Webster County Road C56.
In his report, Morenz said Ismail was westbound on the road in a 2006 Land Rover. She approached a 2008 Chevrolet Silverado, driven by Michael Heuck, 51, of Spencer, which was pulling a car trailer.
“Based on interviews, statements from the defendant and my own observations of the scene, it was determined that the defendant’s vehicle was making an unsafe pass of Heuck’s vehicle when it collided head-on with David Fliehe’s Plymouth Neon which was driving in an easterly direction on C56,” Morenz wrote in the complaint. “The collision caused Fliehe’s vehicle to come to rest in the south ditch and suffer extensive damage to his vehicle.”
Fliehe’s vehicle rolled and ended up on its top in the south ditch.
He was pronounced dead at the scene.
Morenz said Ismail was driving about 70 miles per hour at the time of the crash, while Fliehe was going between 55 and 60 miles per hour.
Ismail was also injured in the crash, and was airlifted to Iowa Methodist Medical Center in Des Moines from UnityPoint Health — Trinity Regional Medical Center. At the time, the Iowa State Patrol said she was suffering from “serious injuries.”
Heuck was not hurt, and his pickup stayed on the road. He was able to stop without further problems.
Morenz said he obtained a warrant for a urine sample from Ismail. According to the complaint, seven hours after the collision, her blood alcohol concentration was .101, which is over the legal limit.
In the complaint, Morenz wrote that he “determined that the defendant was making an unsafe pass of the Heuck vehicle when her vehicle collided head-on with Fliehe’s Plymouth Neon. Directly contributing to the defendant’s unsafe driving manner was her level of intoxication resulting in her impaired decision-making skills and driving capabilities which directly lead to the death of David Fliehe.”
Ismail appeared last Wednesday morning in Webster County Magistrate Court for her initial appearance.
Magistrate Steve Kersten ordered Ismail held on $100,000 cash-only bond, and scheduled a preliminary hearing for this coming Friday.
Kersten also appointed attorney Judd Parker, of Adel, to represent her.
After his appointment, Parker filed a motion for bond reduction. Kersten ordered that a bond review hearing will be held at the same time as the preliminary hearing.
