Faces murder charge in Preston death

The trial date for the man charged in the death of a Fort Dodge teenager has been set for next year in Fort Dodge.

Derrick J. McElroy, 26, of Fort Dodge, will stand trial for first-degree murder beginning May 14, 2013.

McElroy is accused of shooting Brandyn Preston, 19, of Fort Dodge, in May 2011; the crime allegedly led to Preston's death earlier this year.

McElory has been in jail on $1 million cash-only bond since his arrest in July, which came after more than a yearlong investigation into Preston's shooting.

On May 8, 2011, Mother's Day, Preston was shot in the neck while attending a bonfire party at 1101 10th Ave. S.W.

He was taken to Trinity Regional Medical Center before being transferred to Iowa Methodist Medical Center in Des Moines.

Preston was left paralyzed from the shoulders down as a result of the shooting.

After his release from the hospital in June 2011, Preston moved in with his mother, Kimberly Susan Wood, in Tampa, Fla. He lived there until his death on Jan. 22 of this year. He was 20 years old.

Fort Dodge police said Preston's death was the result of the shooting, and reclassified their investigation as a murder after his death.

McElroy pleaded not guilty in early August, and his trial was initially scheduled for Sept. 25. It was moved back after McElroy waived his right to a speedy trial.
