State attorney general to aid in murder case
Calhoun County Attorney requests state’s assistance
ROCKWELL CITY — Calhoun County Attorney Ben Smith has requested assistance from the State of Iowa Attorney General’s office in the case against Nathaniel Bevers-McGivney.
Court documents filed on Monday in Calhoun County court stated that Smith had recused himself from the case and given it over to the state “due to a conflict of interest.” However, that file was amended Thursday stating that it was made in error. Instead of giving the case over to the attorney general’s office, the state will be assisting Smith.
Bevers-McGivney, 21, is charged with first degree murder in the death of 17-year-old Michele “Luna” Jackson last week. A criminal complaint alleges that Bevers-McGivney “deliberately and premeditatedly” cut Jackson’s throat.
Bevers-McGivney is scheduled for a preliminary hearing in Calhoun County Court this afternoon at 3:30 p.m.
