Bevers-McGivney waives right to speedy trial after demanding it
ROCKWELL CITY — Just days after allegedly killing Michele “Luna” Jackson at the Farnhamville City Park, Nathaniel K. Bevers-McGivney demanded his right to a speedy trial.
Bevers-McGivney is charged with first-degree murder in the death of 17-year-old Jackson on Sept. 23.
On Oct. 11, Bevers-McGivney’s attorney filed documents with the Calhoun County Clerk of District Court stating that his client demanded a right to a speedy trial, under a rule of criminal procedure which stated that a trial must proceed within 90 days of filing.
The trial was scheduled to begin Nov. 19, at the Calhoun County Courthouse in Rockwell City. However, Bevers-McGivney is now waiving that right and next week’s trial date has been canceled. His attorney filed paperwork to extend deadlines for discovery and pre-trial matters. A new trial date has not yet been set.
Bevers-McGivney allegedly “cut the throat of (Jackson), and stabbed her body multiple times. (She) died as a result of having her throat cut and/or being stabbed multiple times by the defendant. The defendant committed these acts with malice aforethought, willfully, deliberately, premeditatedly, and with the specific intent to kill (Jackson),” criminal complaints filed against him state.
Bevers-McGivney is also charged with abuse of a corpse for concealing Jackson’s body and the crime scene.
